Executive Rules and Instructions of Kuwait Income Tax Decree No. 3 of 1955 as amended by law No. 2 of 2008

Executive Rule No. 19 Concerning registration of investment funds, portfolios and investment in Kuwait Stock Exchange

Article No. 13 of the Executive Regulations

First: Investment funds managers, investment custodians and companies managing funds, portfolios or investment in Kuwait Stock Exchange for the interest of Incorporated Bodies subject to Kuwait Income Tax Decree shall apply to Tax Department to register funds, portfolios or the Incorporated Body investing in Kuwait Stock Exchange through filling in registration form designated for such purpose provided that mentioning information related to Kuwaiti or gulf Incorporated Bodies separately from the information of foreign Incorporated Bodies.

Second: Incorporated Bodies which own or invest directly in investment banks or companies listed in Kuwait Stock Exchange shall apply to Tax Department to register as of commencing activity through filling registration form designated for such purpose.

Third: Registration forms include the following:

  • Name of fund or portfolio

  • Name of Incorporated Body in Arabic and English

  • Nationality of Incorporated Body

  • Date of commencing the activity

  • Portfolio No.

  • Period for which dividend is distributed

  • Percentage of Incorporated Body's contribution in the company

  • Share of Incorporated Body in profits or dividends

  • Nature of activity of Incorporated Body

  • Investment custodian or fund manager

Fourth: the following information shall be attached with the form:

  • Copy of memorandum of association

  • Copy of shareholders' registry as at the time of holding the general meeting

Fifth: forms will be signed and approved with seal and signature of incorporated body's representative along with its capacity and present the evidence thereof.
